Due to a lack of space, nearly 6 000 disabled children will be forced to stay at home at the beginning of school year 2013 – and this is most likely the tip of the iceberg only.
In a progress report issued in July 2012 (PDF), senators Claire-Lise Campion and Isabelle Debré have estimated that nearly 20 000 disabled children subject to compulsory education are not attending school.
As Fabienne Jégu, expert close to the human rights Defender, underlines : the State is responsible for this situation. « The french legislation is clear : the State is under the obligation to provide a school education to children, teenagers and adults with disabilities or showing an incapacitating disorder, according to l’article L. 112-1. of the Education Code. Such an obligation has been reaffirmed by the law of february 11 2005 which is meant to strengthen necessary actions to provide schooling to disabled children. »
