A new measure to strengthen children's rights

A new legal instrument will enter into force in april. It will allow children and their legal representatives to bring a complaint before the UN Committee on the Rights of the Child in case of violation of their rights. Costa Rica is the tenth State to ratify the third optional Protocol to the Rights of the Child Convention – which will allow the document to come into effect.

« The Committee of the rights of the child shall take measures to protect children who will make complaints against retaliation, by asking the State to take provisional measures in order to protect a child or a group of children.

In case of a State being found guilty of having violated the Convention, it will be forced to implement the recommandations made by the Committee.

However, the children allowed to complaint are only those whose governments have ratified the Protocol. »

Childs Rights Information Netword (CRIN) has produced a practical guide to explain how the complaints mechanism works. A child-friendly version of the Protocol has been published in english by the UN Secretary General representitive on violence against children.
